TermsSoftware Development Grant: Terms and Conditions

1. The Grant

1.1The Software Development Grant (the “Grant”) is offered by AGBTECH CONSULTING (“AGBTECH”) to eligible businesses registered in Malaysia. The business applying for the Grant is referred to as the “Applicant”.

1.2The Grant is applied as a credit of between RM3,000 and RM10,000 against the fees for software development services performed by AGBTECH for the Applicant, comprising requirements analysis, design, development, testing and deployment.

1.3The Grant is not payable in cash, is not transferable and may not be exchanged for any other product or service.

1.4Where the agreed scope of work exceeds the value of the Grant, the balance is payable by the Applicant in accordance with a written quotation accepted by the Applicant before work begins.

2. Costs not covered

2.1The Grant does not cover web hosting, servers or cloud infrastructure; domain name registration or renewal; SSL certificates; third-party software licences, subscriptions or usage charges; hardware; or any work outside the agreed scope. Such costs, where applicable, are borne by the Applicant.

3. Eligibility

3.1The Applicant must be a business entity registered with the Companies Commission of Malaysia (SSM) and actively operating in Malaysia.

3.2Each business entity may submit one (1) application per intake. Applications by related entities for the same problem are treated as a single application.

3.3The application must be made by a director, owner or partner of the Applicant, or by a representative duly authorised by the Applicant.

4. Application and supporting documents

4.1The Applicant shall ensure that all information provided is true, accurate and complete. AGBTECH may reject an application, or withdraw an approved Grant, if any information is found to be false, misleading or incomplete.

4.2All supporting documents must be submitted within seven (7) calendar days from the date of application. An application with documents outstanding after this period is deemed withdrawn.

4.3Estimates of loss and gain must be made in good faith. AGBTECH may request records that support them.

4.4AGBTECH may request further information or clarification at any time during assessment.

5. Assessment and approval

5.1Applications are assessed on the clarity of the problem described, the losses it causes or the gains available if it is resolved, the credibility of the estimates provided and the Applicant’s commitment to the pilot.

5.2The software solution, including its scope and design, is determined by AGBTECH based on its assessment of the problem described.

5.3The value of each Grant is determined by AGBTECH within the range stated in clause 1.2, based on criteria including the uniqueness and urgency of the problem, and is stated in the letter of offer.

5.4Submission of an application does not guarantee approval. Grants are limited in number and are awarded at the sole discretion of AGBTECH, whose decision is final. AGBTECH is not obliged to give reasons for any decision.

5.5A Grant is approved only upon AGBTECH issuing a written letter of offer to the Applicant.

6. Pilot period

6.1The Applicant shall undertake a pilot of the delivered software for a minimum period of six (6) months from the date of grant approval.

6.2During the pilot, the Applicant shall use the software in the ordinary course of its business and provide such feedback as AGBTECH may reasonably request.

6.3If the Applicant discontinues the pilot before the end of the minimum period without the written consent of AGBTECH, AGBTECH may invoice the Applicant for the value of the Grant utilised.

7. Personal data and confidentiality

7.1Personal data provided in this application is processed by AGBTECH in accordance with the Personal Data Protection Act 2010 for the purposes of assessing the application, administering the Grant, corresponding with the Applicant, and security and fraud prevention.

7.2Where the application was made through an introducer, the introducer may be informed of the application and its outcome.

7.3Information concerning the Applicant’s business is treated as confidential and is not disclosed to any third party, except service providers acting on behalf of AGBTECH or where required by law.

7.4The Applicant may request access to, or correction of, its personal data by writing to support@agbtechconsulting.com.

8. General

8.1The detailed scope of work, and the ownership and licensing of the delivered software, are set out in the letter of offer and the development agreement between AGBTECH and the Applicant.

8.2AGBTECH may amend these terms, or suspend or withdraw the programme, at any time. An approved Grant is governed by the terms in force on the date of its letter of offer.

8.3These terms are governed by the laws of Malaysia.
